Bihar: High Court Takes Strict Stand on Mental Health, Seeks Government Response; Orders Filing of Affidavit by May 8

The Patna High Court has taken a serious stance regarding the rising number of mental illness cases in Bihar and the condition of homeless patients wandering on the streets. Taking suo motu cognizance of the issue, the court has sought a response from the state government and directed it to submit a detailed affidavit by May 8, 2026.

A bench headed by Chief Justice Sangam Kumar Sahu clearly stated that preparations regarding a sensitive issue like mental health should not remain confined to files but must be effectively visible on the ground.

Government’s Stand: Claim of Improving Facilities

During the hearing, the state government informed the court that facilities in mental health institutions are being continuously improved. From October 1, 2025, free meals have been provided to patients, with an expenditure of ₹182.32 per patient per day.

Additionally, at the Bihar State Mental Health and Allied Sciences Institute, 144 types of medicines are being provided free of cost, for which a formal notification was issued in December 2025.

Rising Numbers, Persistent Challenges

Hospital data indicates a steady increase in the number of mental health patients. While 15,500 new patients were registered in 2023–24, the number rose to 20,677 in 2024–25.

Moreover, the ‘Tele-MANAS’ helpline has emerged as a support system, with over 36,000 people receiving counseling since 2022.

Rehabilitation Efforts: Patients Reunited with Families

The most positive aspect of the report is the rehabilitation of patients. Over the past 5–6 years, more than 100 missing or displaced patients have been reunited with their families with the help of police and administration. In 2026 alone, 5 patients have already been sent back home after successful treatment.

Future Plans and Court’s Strict Approach

Currently, the institute has a capacity of 180 beds, including wards for men, women, and prisoners. However, given the rising patient load, plans are underway to increase bed capacity.

The High Court has also appealed to the public to report mentally ill persons seen on the streets via a 24×7 toll-free number, so that timely rescue and treatment can be ensured.

The next hearing in the case is scheduled for May 11, 2026, where the government will have to present a concrete action plan. The court’s strict stance has raised hopes for significant improvements in mental healthcare in Bihar in the near future.
