Offering Funeral Prayers for a Slain Militant Not Anti-National:J&K and Ladakh HC

Patna(CNA Media/Insaaf Times) The Jammu & Kashmir and Ladakh high court ruled that the public can offer funeral prayers for slain militants, and it cannot be termed ‘anti-national’ activity. This is denying them their personal liberty as guaranteed by Article 21 of the Constitution.The J&K government has stopped handing over bodies of armed militants to their families citing COVID-19 concerns and burying them in remote locations. The year 2020 saw nearly 140 militants buried in such places, prominently in northern Kashmir.Umer Maqbool’s report from 2020 quotes villagers of Gantamulla stated they had ‘silently buried’ more than a 100 militants in a graveyard that was for unidentified and non-local militants. Security forces believe that funerals held in populated areas of Kashmir could incite law and order problems.Instances of police in the Valley booking attendees of militants’ funerals have also been reported.
