Guwahati High Court has quashed the National Security Act (NSA) detention of Assam’s Dhing MLA Aminul Islam and ordered his release, provided he is not involved in any other case. Islam was arrested six months ago over remarks in which he described the Pahalgam and Pulwama attacks in Jammu and Kashmir as a “conspiracy” by the central government.
A bench comprising Justice Kalyan Rai Surana and Justice Rajesh Mazumdar ruled that Islam’s NSA detention was invalid. The court noted that authorities had caused unnecessary delays in addressing his representation against the detention and that he was informed of his right to appeal to the Union government only after a significant delay.
Islam’s lawyer, Santanu Borthakur, stated that the MLA is expected to be released on Friday.
The legislator was arrested on April 24 after claiming at a political rally that the April 22 Pahalgam attack was a conspiracy orchestrated by the central government. Although he had previously secured bail, he was immediately taken into NSA custody on the same day.
Islam was booked under BNS Section 152 and other provisions, which relate to acts endangering India’s sovereignty, unity, and integrity. The NSA detention order was issued by the Deputy Commissioner of Nagaon, who alleged that the MLA was “engaging in activities prejudicial to public order and state security.”
The High Court observed that delays in addressing his representation and informing him of his right to appeal violated his constitutional rights. The court ruled that the detention was illegal and ordered his immediate release.
AIUDF chief Badruddin Ajmal called Islam’s detention under the NSA politically motivated, stating, “He committed no offense that falls under the NSA. He was granted bail, but then detained under the NSA as part of a conspiracy.”
